Giving the direction on a petition by Ayurveda doctor D Uma Maheswari, vacation judge Justice K Ravichandra Baabu ordered issuance of notice to the State Health Secretary, Tamil Nadu Public Service Commission (TNPSC), Medical Service Recruitment Board, and Secretary of Indian Medicine and Homoeopathy seeking their reply within six weeks.
According to the petitioner, originally the recruitment for medical and paramedical and non-medical category of government services was made through TNPSC.
However, considering difficulties in the mode of appointment and the delay caused in recruitment, a separate body -- Medical Services Recruitment Board (MRB) -- was formed by the government in January 2012.
The TNPSC issued a notification on March 26 this year for the recruitment to fill several vacancies of doctors which fall under the purview of MRB.
The petitioner submitted that once a specialised body MRB had been constituted, TNPSC had no jurisdiction to conduct recruitment of the medical officers.
Hence, he prayed the court to quash the March 23 notification and direct the authorities to conduct the recruitments through the MRB.
